testing equipment. A donor simply breaths into the breath testing device, and their level of
breath alcohol is immediately determined and the results printed. Each machine is maintained

Is Drug Testing Legal?
In some states there are a few drug-testing restrictions. Generally all employers have the right
to establish a written drug testing policy which requires employees to be drug free and comply
with the company drug testing policy and procedures.

Do we have to test all new hires?
Yes, if you have implemented a pre-employment testing. As the employer you cannot
selectively choose who you want to test.

What if an employee refuses to take a drug or alcohol test?
This is why it is important to have a company policy in place which clearly states the action
the employer will take in case of refusal. Most policy state that refusal will result in the
immediate termination of the employee.
